How to submit a complaint (motion) to the Chamber of Judicial Officers of the Czech Republic

A submission may always be made in written form, as follows:

  • by e-mail to: podatelna@ekcr.cz
    (in the case of a complaint, a qualified electronic signature is required; general inquiries may be submitted without a qualified electronic signature),
  • via data mailbox – ID DS: vfrai9p,
  • by post to: Chamber of Judicial Officers of the Czech Republic, Radnická 14/16, 602 00 Brno, Czech Republic,
  • via the online advisory form within the online legal advisory service
    (this serves only for obtaining initial information; the advisor may refer the applicant to submit the motion in another form).

 

What to include in your submission

 

Please include:

  • if the submission is made by an authorised representative, also the identification details of the representative;
  • your status in the relevant proceedings (debtor, creditor, third party – auction participant, employer, etc.);
  • information on any remedies already filed or other motions submitted (appeal against the order to commence enforcement, motion to stay enforcement, motion to suspend enforcement, objections against the enforcement cost order, motion to exclude movable property from inventory, exclusion lawsuit, or other motions);
  • a brief description of the facts in which you see a procedural or legal error by the judicial officer and what remedy you are seeking;
  • information on whether a supervisory complaint has been submitted to another authority (president of the court, Ministry of Justice), and how it was resolved, or attach copies of such decisions if available.

For efficient handling, please also attach copies of relevant documents supporting your statements.
